Terms & Conditions

These Terms & Conditions apply to all work carried out by Downham Sparkit (“we”, “us”, “our”) for the client (“you”, “the customer”).

By accepting a quotation, booking work, or using our services, you agree to these Terms & Conditions.
 

1. Quotations and Estimates

1.1 All quotations are valid for 30 days unless otherwise stated in writing.

1.2 Quotations are based on the information available at the time of inspection or discussion.

1.3 Any additional work requested by the customer, or required due to unforeseen issues, may result in additional charges.

1.4 Estimates are approximate only and may change depending on the final scope of work.
 

2. Unforeseen or Hidden Issues

2.1 Electrical installations may contain hidden faults or non-compliant wiring that cannot reasonably be identified before work begins.

2.2 If unforeseen issues are discovered during the work, we will inform the customer as soon as reasonably possible before proceeding with additional chargeable work where practical.

2.3 Additional remedial work required to bring installations up to current safety standards may incur extra costs.
 

3. Payment Terms

3.1 Payment is due within 14 days from the invoice date unless otherwise agreed in writing.

3.2 Late payments may incur interest at a rate of 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

3.3 We reserve the right to suspend ongoing or future work where invoices remain unpaid.

3.4 Electrical certificates, test results, or documentation may be withheld until payment has been received in full.
 

4. Methods of Payment

4.1 We accept payment via:

  • Bank transfer

  • Cash

4.2 Bank details will be provided on the invoice.

4.3 Customers should use the invoice number as the payment reference where possible.
 

5. Deposits

5.1 We reserve the right to request a deposit before commencing work or ordering materials.

5.2 Deposits are generally non-refundable once materials have been purchased or work has commenced.
 

6. Ownership of Materials

6.1 Materials and goods supplied by Downham Sparkit remain our property until payment has been received in full.

6.2 We reserve the right to recover outstanding debts through legal means where necessary.
 

7. Customer-Supplied Materials

7.1 We cannot guarantee or accept liability for materials, fittings, fixtures, or equipment supplied by the customer.

7.2 Additional labour or visits required due to faulty, incompatible, delayed, or unsuitable customer-supplied items may incur additional charges.
 

8. Workmanship Guarantee

8.1 We guarantee our workmanship for a period of 12 months from the completion date.

8.2 This guarantee does not cover:

  • Misuse or accidental damage

  • Wear and tear

  • Faults caused by third-party interference

  • Customer-supplied materials or equipment

  • Existing or unrelated electrical faults

8.3 Manufacturer warranties remain subject to the manufacturer’s own terms and conditions.
 

9. Compliance and Certification

9.1 Electrical work will be carried out in accordance with relevant UK regulations and standards applicable at the time of installation.

9.2 Certification will be provided where legally required or applicable to the work undertaken.
 

10. Liability

10.1 While every reasonable care is taken during works, Downham Sparkit shall not be liable for:

  • Pre-existing faults or unsafe installations

  • Damage caused by defective customer equipment

  • Indirect or consequential losses

  • Loss of earnings, business interruption, or loss of profits

  • Delays caused by factors outside our reasonable control

10.2 Our total liability shall not exceed the total value of the work carried out.
 

11. Access and Safety

11.1 The customer must provide safe and reasonable access to the work area.

11.2 We reserve the right to stop work where unsafe conditions are identified.

11.3 Delays caused by restricted access, unsafe environments, or customer-related issues may result in additional charges.
 

12. Cancellations and Rescheduling

12.1 Customers should provide at least 48 hours’ notice for cancellations or rescheduling.

12.2 Late cancellations may incur a call-out or administration charge.

12.3 If work is cancelled after materials have been purchased, the customer may be charged for those materials.
 

13. Waste Removal

13.1 Unless otherwise agreed, removal of old fittings, packaging, rubble, or electrical waste is not included within quotations.

13.2 Waste disposal services may be provided at additional cost.
 

14. Parking and Access Costs

14.1 Any parking charges, permits, congestion charges, or access-related costs required to complete the work may be added to the final invoice unless agreed otherwise in writing.
 

15. Force Majeure

15.1 We shall not be liable for delays or inability to complete work due to circumstances beyond our reasonable control, including:

  • Severe weather

  • Supplier shortages

  • Illness or injury

  • Traffic delays

  • Power outages

  • Acts of God

  • Government restrictions

16. Website Use

16.1 Information provided on our website is for general guidance only.

16.2 We make reasonable efforts to keep website information accurate and up to date but do not guarantee completeness or accuracy.

16.3 Unauthorised use of this website may give rise to legal claims.
 

17. Privacy

18. Consumer Rights

18.1 Nothing within these Terms & Conditions affects your statutory rights under applicable UK consumer law.
 

19. Governing Law

19.1 These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

19.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
